I just asked the Tolkien Estate about permission to use Tolkien related material in a publication and they where really nice. I just about screamed yesterday when I opened my email account and saw that I got an email from Adam Tolkien! If any one ever is worried about using Tolkien created material you should go to tolkienestate.com and ask in the FAQ section. Though it takes awhile before they respond.
